Tax, revolt leaders: 400 in substandard suing government – BBC

There is another front that opens to the Inland Revenue. And this time it’s a front, of “friendly fire”. Still about the story of the more than 800 executives “degraded” to the status of mere functionaries, after the Constitutional Court ruling that judged illegitimate their promotions, because they arrive with internal procedures and not for competition. But with an important innovation.

Half of them, about 400, came into the open in opposition to the decision. And he did suing in a civil forum in Rome the Presidency of the Council of Ministers and the Director of Revenue, Rossella Orlandi. Ask two things the applicants. The recognition of the status of ruling indefinitely. Or compensation for damages suffered after their ‘demotion’. Damages to be calculated in terms of salary, given that on average have gone from a payroll of 4,000 euro net per month to about 1,700. Both in terms of loss of career opportunities. The sum is not specified, it will eventually be quantified in court. But the estimates point to a figure, of course, if you win the appeal, around 60 million Euros, adding other items to 20 months that are usually recognized in such cases.

The leadership of the Agency are called into question because the same day of publication of the judgment of the Constitutional Court, director Rossella Orlandi signed letters of revocation for all executives involved, thus formalizing their relegation. The Council Presidency, in the person of Prime Minister Matteo Renzi, is sued for another reason. And that is, for not having implemented in Italy with European legislation which prohibits temporary contracts lasting more than three years. The point is this. The 800 executives demoted all had a task to complete. But, in most cases, it has been renewed or extended, reaching even to periods of more than ten consecutive years. It is no coincidence that more than half of the applicants will be paid to the law firm Mascolo, the same that has followed the story of the temporary school. And who got the European Court of Justice judgment “Mascolo,” one that recognized the right assumption for temporary teachers with at least three years of service. A road which then led to the hiring of temporary workers, the reform of the school of government Renzi.

It is said that goes the same way with the Inland Revenue. But it could. And the judicial process is also an instrument of pressure “political”. In recent weeks we have been several amendments tabled in Parliament to ask the stabilization managers demoted, or at least the creation of new positions for executives completed. A line so far always rejected by the government. But now the Senate is working on the bill of stability. And, you can bet there will be new attempts.
